What is Embezzlement?
The offence of embezzlement occurs when someone who has been entrusted with property, cash or other assets steals or uses it dishonestly for their own purposes. Embezzlement is in many ways similar to the offence of theft, although the penalties for those convicted of embezzlement can often be significantly harsher.
Under What Circumstances is Embezzlement Likely to Occur?
Embezzlement can occur in a broad range of contexts in which individuals have access to, or responsibility for, money or other assets that they do not own.
This offence is often associated with the misappropriation of public money by those employed by government bodies and other public institutions. Similarly, charities can also be the subject of embezzlement if funds are misused or fraudulently appropriated by trustees or staff.
In a commercial context, embezzlement can take place when employees or company officials appropriate money that belongs to their employer or clients of their company. Embezzlement can also occur in dealings between private individuals. An example would be when someone appointed as the executor of an estate following a death misuses the assets or fails to distribute the estate as they have been instructed in the Will.
What Are the Consequences of a Conviction for Embezzlement?
Embezzlement is considered a particularly serious offence – this is because, by its nature, it involves a significant breach of trust. As a consequence, penalties following a conviction for embezzlement can be severe.
Cases may be heard in the Sheriff Court, or the High Court in more serious or substantial cases. A conviction in the Sheriff Court can result in a prison sentence of up to five years, while the High Court has the power to sentence those convicted of embezzlement to custodial sentences that are even longer. In light of such serious consequences, it is vital to speak with an experienced criminal defence solicitor immediately if you are accused of this offence.
